Foreign nationals in South Africa who have been granted visa concessions are bracing for a critical deadline: Wednesday, 1 April 2026. Until now, those awaiting decisions from the Department of Home Affairs (DHA) were protected from being classified as ‘undesirable.’ However, this concession ends on Tuesday, 31 March 2026, leaving many uncertain about their future in the country.
The DHA’s backlog of applications has led to significant delays, and with no clear plan to extend the concession, these individuals risk being forced to leave South Africa abruptly. Unfortunately, the fate of applicants with pending waivers and appeals remains unclear.
While the concession has been extended several times since 2022, those affected by the DHA’s delays have limited recourse. If the concession is not extended, they may face serious consequences for overstaying their visa conditions. Typically, foreign nationals can escalate their applications through litigation, but this process can be costly and uncertain. Legal experts argue that the cost of escalating proceedings against the DHA might be less than the cost of an abrupt departure.

Without an extension of the concession, the following groups risk losing their status overnight:
Legal experts question whether extending the concession is sufficient or if a more permanent solution is needed to address the uncertainty and anxiety caused by DHA processing delays. They suggest that the government should consider expanding the protection framework and implementing alternative administrative measures to assist these individuals.
Many affected applicants have been in South Africa for decades, married to South African citizens or permanent residents, and are gainfully employed. They have been patiently waiting for DHA adjudication since 2022, and this situation is not of their making. The stress they have endured is unnecessary, and it’s essential to find a solution to alleviate their plight.
